General Terms and Conditions

§ 1) Scope

Every customer of Skyline Cycling GmbH acknowledges the following terms of sale and delivery with his order. We reserve the right to change these without notice if necessary.

§ 2) Prices

The prices are subject to change and are quoted in Swiss Francs, including value added tax. For small quantity orders (value of goods < Fr. 50.-) we reserve the right to charge a small part of our expenses in the form of a small quantity surcharge of Fr. 10.- if necessary.

§ 3) Services

Cost proposals and offers are free of charge and non-binding, unless otherwise agreed. The presentation of the products in the online shop is not a legally binding request, but a non-binding online catalogue or a non-binding request to the customers to order the product in the online shop.

§ 4) Orders

Orders are accepted via our webshop, by phone or e-mail. All remain without obligation without written confirmation. Orders placed before 14:00 will be processed the same day.

§ 5) Shipping/Delivery conditions

The delivery address of the customer must be in Switzerland or the Principality of Liechtenstein. All agreed delivery dates are indicative and not binding. Skyline Cycling is entitled to make partial deliveries at any time. Claims for compensation in the event of possible delays or complete failure to deliver cannot be granted in our role as distributor. Cancellations in the event of delays are not automatically possible and must be discussed on a case-by-case basis. Transportation is ex warehouse at the risk and expense of the customer. We reserve the right to choose the packaging. Packaging costs shall be borne by the customer. For an order value of up to CHF 300.00, postage and packaging costs of CHF 13.50 will be charged. Delivery costs for bulky goods or voluminous orders will be charged according to the situation.

§ 6) Payment and retention of title

Only for retailers:
As the advance payment of Skyline Cycling GmbH is associated with a default risk, the payment variant advance payment is used. The goods are usually dispatched on the next working day after receipt of payment. The goods remain reserved until receipt of payment (maximum 7 days). Sale on account is reserved for known customers. Our invoices are payable within 30 days net from date of invoice. If payment is made late, the customer will be charged interest on arrears at a rate of 7% p.a. from the 40th day. In addition, a reminder fee of CHF 20.00 is charged from the 1st reminder onwards. Invoices not paid or paid too late release us from any delivery. In return, however, this does not release the customer from his obligation to accept delivery. The goods delivered by us shall remain the property of Skyline Cycling GmbH until the purchase price, including all ancillary claims, has been paid in full.

Only for end consumers:
As means of payment we accept advance payment, credit card (VISA, Mastercard), Postfinance and TWINT.

§ 7) Complaints

If products with obvious damage to the packaging or contents are delivered, the customer must immediately complain to the delivery agent and refuse acceptance, without prejudice to his rights to claim for defects. The customer is obliged to have a damage confirmation report from the delivery person handed over to him. In addition, all transport damage must be reported to us immediately. Furthermore, it is the customer’s responsibility to check the ordered products immediately upon receipt and to store them correctly. Any defects or deviations from the order must be reported to us in writing within eight days of receipt. If hidden defects in the goods delivered by us are discovered within the limitation period of 6 months, we will provide a replacement, which however will in no case exceed the invoice value of the delivered goods.

§ 8) Conditions of return

Goods will only be taken back after prior agreement within 10 days. When returning an item please e-mail or call us for a Return Authorization number (RA). Write the RA number on the outside of the box with the delivery note on the inside. Returned items without a RA number will be returned to the sender. The return must be free of charge. Goods which are not in original packaging or in perfect condition will not be accepted and will be returned to the sender. All additional expenses incurred in order to establish the saleability of an item (labelling, packaging, etc.) will be deducted from the credit to be issued at a flat rate of CHF 15.-. We reserve the right to charge a deduction of 10% of the net value of the goods to the credit notes for approved returns which cannot be attributed to a lack of material.

Exception: No right of return for residual items.

§ 9) Warranty claims

Guarantees or warranties are given for delivered goods to the extent that they are granted by our suppliers. All costs incurred, in particular shipping, packaging, removal and installation costs, shall be borne by the customer. In general, a warranty period of two years applies to our entire range of products.

§ 10) Place of performance

Place of performance is 8610 Uster.

§ 11) Applicable law and place of jurisdiction

Swiss law is applicable. Place of jurisdiction is the district court 8610 Uster.
